Alliance of California Judges

The Directors of the Alliance of California Judges join in the recommendations and arguments presented by the California Judges Association in its letter of March 18, 2013, to the Commission on Judicial Performance.  As the letter states:

“Representatives of the CJA met with the commission to raise concerns from many of its members regarding the commission’s issuance of advisory letters and the use of newly discovered evidence during the appearance process.“

CJA presented proposals to amend the commission’s rules regarding the issuance of advisory letters and to amend rule 114(b).  CJA also indicated its willingness to work with the commission in order to address the concerns that formed the basis of the suggested amendments.  The commission failed to acknowledge or address most of the legitimate concerns expressed by CJA, the Alliance of California Judges, and several individual judges and justices from throughout the state.

Here is a link to the March 18, 2013 letter.  We urge you to disseminate it to the judges of your court.  The proposed amendments are consistent with the controlling principles of law and judicial ethics, and they are fair, just and balanced.   The proposals guarantee that judges are afforded basic rights that are consistent with the goals of justice contemplated by the Constitution when faced with allegations of misconduct. We join in urging the commission to reconsider the proposals submitted by CJA.
